Effective date: April 5, 2026. These Terms of Service (“Terms”) are a legal agreement between you and PulseQuest (“PulseQuest,” “we,” “us”). They apply to our website, mobile app, and related services (collectively, the “Service”).

1) Eligibility. You must be at least 13 years old (or the minimum age required in your country) to use the Service. If you are using the Service on behalf of an organization, you represent you have authority to bind that organization to these Terms.

2) Accounts & security. You are responsible for the activity on your account and for keeping your login credentials secure. Notify us promptly if you suspect unauthorized access.

3) Your use of the Service. You agree not to misuse the Service, interfere with its operation, attempt to access non-public areas, or use the Service in a way that violates applicable law. We may suspend or terminate access if we reasonably believe you have violated these Terms.

4) Health & fitness disclaimer. PulseQuest provides habit tracking and informational tools only. It is not medical advice and is not a substitute for professional care. Consult a qualified healthcare professional before making health decisions, especially if you have a medical condition or are taking medication. Use of the Service is at your own risk.

5) Content you provide. You retain ownership of content you submit (such as profile info, mission notes, or feedback). You grant PulseQuest a worldwide, non-exclusive license to host, store, reproduce, and display that content solely to operate and improve the Service.

6) Intellectual property. The Service, including its software, design, and branding, is owned by PulseQuest or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service unless we give you written permission.

7) Paid features. At launch, PulseQuest may offer a free plan. If we introduce paid features later, additional terms (including billing and cancellation) may apply and will be presented to you at the time of purchase.

8) Third-party services. The Service may integrate with third-party services (for example, device platforms or analytics). We are not responsible for third-party services and your use of them is governed by their terms.

9) Termination. You may stop using the Service at any time. We may suspend or terminate your access to the Service, with or without notice, if required by law or if you violate these Terms. Sections that by their nature should survive termination will survive (including intellectual property, disclaimers, limitation of liability, and dispute terms).

10) Disclaimers. The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

11) Limitation of liability. To the maximum extent permitted by law, PulseQuest will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from or related to your use of the Service.

12) Indemnity. You agree to indemnify and hold harmless PulseQuest from claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Service or violation of these Terms.

13) Changes to these Terms. We may update these Terms from time to time. If changes are material, we will provide reasonable notice (for example, by posting an update in the Service). Your continued use after the effective date of the updated Terms constitutes acceptance.

14) Governing law. These Terms are governed by the laws of your place of residence unless applicable law requires otherwise.
